Terms of Service

These Terms explain the rules for using the QuoteBuddi website, live demo and demo request form. We've tried to keep them readable. If anything is unclear, email us at hello@quotebuddi.com.

1. Agreement to these Terms

These Terms of Service (the "Terms") govern your access to and use of the QuoteBuddi website, including its pages, live demo, pricing tools and forms (together, the "Website"). The Website is operated by QuoteBuddi ("QuoteBuddi", "we", "us" or "our"), a business based in Alberta, Canada.

By using the Website, or by checking the box on our demo request form, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, please do not use the Website.

If you use the Website on behalf of a business, you confirm that you have authority to accept these Terms for that business, and "you" includes that business.

2. Who can use the Website

You must have reached the age of majority in the province or territory where you live, or be using the Website with the involvement of a parent or guardian. The Website is designed for automotive businesses in Canada. If you access it from elsewhere, you are responsible for complying with the laws that apply to you.

3. The live demo and example prices

The live demo on the Website is a scripted simulation that runs entirely in your web browser. It does not connect to a real shop, it is not a real diagnosis of your vehicle, and it does not use your information to make any decision about you.

All prices, rates, packages, taxes, timelines and quotes shown on the Website, including in the demo and our interactive tools, are illustrative examples only. They are not offers, quotes or estimates from QuoteBuddi or from any shop, and nothing on the Website is professional mechanical, safety, legal or financial advice.

If you have a safety concern about your vehicle, such as grinding brakes or a flashing check engine light, please have it inspected by a qualified technician. Don't rely on the demo.

The demo only uses built-in sample photos. It does not let you upload files. Results from our interactive tools, such as the money calculator, are illustrations based only on the information you enter; they are not predictions or guarantees of results.

4. The QuoteBuddi service for shops

These Terms cover the Website only. If your shop subscribes to QuoteBuddi's quoting service (including the chat widget and related features), your use of that service will be governed by a separate written subscription or service agreement. If that agreement conflicts with these Terms, the agreement governs the service.

Quotes produced by the QuoteBuddi service are estimates generated from the prices and information each shop provides. Each shop remains responsible for its own prices, the final amount it charges, the work it performs, and its obligations to its customers under applicable law, including consumer protection and automotive repair estimate requirements.

5. Acceptable use

When using the Website, you agree not to:

  • use it for any unlawful, fraudulent or harmful purpose;
  • interfere with, disrupt or overload the Website, or attempt to bypass any security measure;
  • attempt to gain unauthorized access to any part of the Website, our systems or other people's information;
  • scrape, crawl or harvest content or data in bulk, other than through ordinary search engine indexing;
  • copy, modify, reverse engineer or create derivative works from the Website, the demo or our code, except where the law expressly allows it;
  • submit false or misleading information, or impersonate any person or business;
  • upload or transmit viruses, malware or other harmful code; or
  • use the Website or our contact details to send unsolicited commercial messages.

6. Demo requests and emails

When you submit our demo request form, you confirm that the information you provide is accurate and that you are allowed to share it. We use it to respond to you and to schedule and run your demo, as described in our Privacy Policy.

We follow Canada's Anti-Spam Legislation (CASL). We will only send you commercial electronic messages when we have your consent, either express or implied as permitted by CASL. Replying to your demo request is part of responding to your inquiry. We do not send newsletters or marketing emails unless you separately agree to receive them.

Every commercial email we send will identify QuoteBuddi, include our contact information and include a working unsubscribe link. We will process unsubscribe requests without delay and in any event within 10 business days.

7. Privacy

Our Privacy Policy explains how we collect, use, disclose and protect personal information in line with the Personal Information Protection and Electronic Documents Act (PIPEDA), Alberta's Personal Information Protection Act (PIPA) and, where applicable, Quebec privacy law. It forms part of these Terms.

8. Intellectual property

The Website and everything on it, including text, graphics, the QuoteBuddi name and logo, the QuoteBuddi character, the demo, page designs and code, are owned by or licensed to QuoteBuddi and are protected by Canadian and international copyright, trademark and other laws.

We give you a limited, personal, non-exclusive, non-transferable and revocable permission to view and use the Website for your own information or to evaluate QuoteBuddi for your business. All other rights are reserved. Third-party names mentioned on the Website, such as website platforms, belong to their owners, and mentioning them does not mean they endorse us.

9. Feedback

If you send us ideas or suggestions, you allow us to use them to improve QuoteBuddi without any obligation to you. We won't publicly identify you as the source without your permission.

10. Links and services run by others

The Website may link to or rely on services run by others, such as font providers, email apps and social networks. We don't control those services and aren't responsible for their content or practices. Your use of them is subject to their own terms and privacy policies.

11. Changes to the Website

QuoteBuddi is a new product. We may change, add or remove features and content on the Website at any time. Features described as "coming soon" are plans, not promises, and may change or not be released. We don't guarantee that the Website will always be available or error-free.

12. Disclaimers

To the maximum extent permitted by applicable law, the Website is provided "as is" and "as available", without warranties, representations or conditions of any kind, whether express, implied or statutory, including implied warranties or conditions of merchantable quality, fitness for a particular purpose, accuracy and non-infringement.

Nothing in these Terms excludes or limits any warranty, condition, guarantee or right that cannot lawfully be excluded or limited, including rights you may have under consumer protection legislation in your province or territory.

13. Limitation of liability

To the maximum extent permitted by applicable law, QuoteBuddi and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, data or goodwill, arising out of or related to your use of, or inability to use, the Website, even if we were told such damages were possible.

To the maximum extent permitted by applicable law, our total liability for all claims relating to the Website is limited to one hundred Canadian dollars (CAD $100).

These limits do not apply to liability that cannot be limited under applicable law, such as liability for fraud, gross negligence, wilful misconduct, or death or personal injury caused by negligence where the law does not allow it to be limited.

14. Indemnity

If you use the Website on behalf of a business, that business agrees to defend and indemnify QuoteBuddi against third-party claims, losses and reasonable legal costs arising from its breach of these Terms or misuse of the Website, to the extent permitted by law. This section does not apply to consumers where applicable law prohibits it.

15. Suspension of access

We may suspend or restrict your access to the Website if we reasonably believe you have breached these Terms or are using the Website in a way that could harm us or others. Sections of these Terms that by their nature should continue (such as intellectual property, disclaimers, limitation of liability and governing law) will continue to apply.

16. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in the law or in QuoteBuddi. We will post the updated Terms on this page and change the "Last updated" date. If we make a material change, we will give reasonable notice on the Website before it takes effect. If you keep using the Website after the change takes effect, the updated Terms will apply. If you don't agree with them, please stop using the Website.

17. Governing law and disputes

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, without regard to conflict of laws rules. Subject to the paragraph below, you and QuoteBuddi agree to the exclusive jurisdiction of the courts located in Alberta.

If you are a consumer and the consumer protection laws of your province or territory (including Quebec) give you the right to bring proceedings in your home jurisdiction or under its laws, nothing in these Terms takes that right away.

If you have a concern, please contact us first at hello@quotebuddi.com. We will try in good faith to resolve it informally within 30 days.

18. Language

These Terms are written in English. A French version will be made available to users located in Quebec. Une version française des présentes conditions sera offerte aux utilisateurs situés au Québec.

19. Accessibility

We want everyone to be able to use the Website. If you have trouble accessing any part of it, or need these Terms in an alternative format, contact us and we will help.

20. General

  • Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and QuoteBuddi about the Website.
  • Severability. If any part of these Terms is found to be unenforceable, the rest will remain in effect.
  • No waiver. If we don't enforce a part of these Terms right away, we haven't given up the right to do so later.
  • Assignment. We may transfer these Terms as part of a merger, acquisition or sale of our business. You may not transfer them without our written consent.
  • Events beyond our control. We aren't responsible for delays or failures caused by events reasonably beyond our control.
  • Interpretation. Headings are for convenience only, and "including" means "including without limitation".
